Yes. A PT10HD license will work with 10.3.8 if you don't have PT11HD.

HD3 working perfectly here, OSX 10.9.1 and PT 10.3.8

Good sweet lord, really? I've got 2 HD3Accel systems and and extra Accel card I could put in a chassis for HD7...heckuva option rather than upgrading to HDx. wow...

Yes. But only if you do a clean install. I tried upgrading from Mountain Lion to Mavericks and it didn't work. But for an empty hard drive, clean Mavericks install, clean Protools install -- works perfectly.
