I know that if you use a sample you have to have it cleared from the writer and the recorder and pay royalties on them, but to use a pattern such as kick snare kick kick snare or any pattern on drums for that matter, and record it yourself either live or midi, I'm sure isn't copyrightable

No, doing that you created it yourself, so I don't believe you can copyright that. That would be almost like Metallica trying to copyright the 'E' chord. However, if you lifted that drum beat straight from another song, but only the drum beat, it would be considered a sample still.

But I agree with you. If copyrights keep getting tighter soon they will infringe on our creative rights.

Not sure on this. It comes down to the song in its entirety. Remember the Queen Vs Vanilla Ice, Satriani Vs Cold Play?

In the queen vs vanilla ice suit, that was because he sampled the piano and bass riff.

You can't sample anything that is recorded without the permission of the people that recorded it.

As for a chord progression or a drum beat, nothing that is recorded, you can use. You can't use a melody, a drum beat and a chord progression arent classed as melodys

Platinum Samples just released a MIDI groove library played by Steve Ferrone (Tom Petty & The Heartbreakers, Average White Band, Clapton) formatted for BFD2, Superior Drummer, EZDrummer, Addictive Drums, Cakewalk Session Drummer and General MIDI...
