Default AVID Europe no longer refund VAT on Vat exempt purchases!

I was about to upgrade my PT HD 11 license to an annual version 12 HD subscription.

I am VAT registered in the UK and as such am VAT exempt from all business related purchases within the EU, as long as I provide my UK VAT number either prior to or immediately after purchase.

I just queried with Avid Europe how this should be processed when ordering, only to receive the following response:

"Hello Julien, According to new regulations, we can not refund VAT value for Avid products. Kind regards,Avid Customer Care"

Has anyone else heard about these "new regulations"? All my other EU purchases do not incur VAT - that is the whole point of VAT and the European Union. No other EU supplier has ever had an issue not charging VAT or refunding after payment.

Until this is resolved, I will not be buying any more Avid products.

What's the reason you are buying this upgrade right now in the first place? There's still no information on the plans with HD and there are zero new features. If you need to get rid of some money, better burn it, or give it to some charity.

Audio engine enhancements allowing for significantly increased efficiency and borne out by numerous accounts on this forum and elsewhere. That alone would justify the upgrade cost. New features in most DAWs are primarily gimmicks these days and therefore of little real value.

I do appreciate your concern for how I spend my money though.

The only openly done comparison of performance 11 vs 12 that I am aware of is the one by PTE. And it showed there is no difference at all.

But whatever rows your boat, I guess.

The phrase is normally "whatever floats your boat" but each to their own.

... and comments I've seen elsewhere do not support the statement above. Still, quite why we're arguing about the motives for me making a personal investment in my DAW of choice is slightly confusing me.

You're right, I confused it, sorry. :)

My motives were of the noblest nature, I was just wondering why anybody would be willing to pay that kind of money at this point. I didn't mean to come across in an unpleasant manner. I apologize if I did.

No apology necessary.

I'm more concerned about Avid's decision to (seemingly arbitrarily) stop following what I understand are still the correct procedures for dealing with business purchases of their products, and the whole issue of EU VAT exemption.

Not very exctiing I know, but I can't help feeling it'll cost them sales.

Νever heard of this 'new regulations' either...
The only thing (?)that i can think of -if makes sense- is that their system looks as it is a 'local' transaction based so the VAT should be calculated on top?
Otherwise really makes no sense at all, that this is sustainable only for AVID (LOL)

Unless as per this doc (updated March 24),there is something that i am missing off.

If you have a correct Vat ID Avid should not charge you vat.
Buisiness to buisiness are handled as ever as I know.

The new regulations started at 1 January. It affect only buisines with digital delivery.
The dealer must charge you your local vat rate if you do not have a vat ID.

Thats why some small companies stopped selling in some cases.
The only chance is to sell product with big shop systems like fastspring...

I wonder how much more income to the european states this generated for example from itunes/amazon.......downloads which now include local taxes and not those 3 percent they charged you from luxemburg.

I am sure avid must not charge you.
But feel free to get your product from another company that accepts your buisiness vat ID. Iam sure you will also get a better deal as from the avid website.

By way of an update, I have made no progress with Avid's european store.

Their current position is:

1. Once VAT is charged they will refuse to refund it (they say they are no longer able to because of new regulations).

2. They are unable to waive VAT during the online checkout process because they don't have a box on their site which enables you to add your VAT details!! - basically they can't be bothered to run an online retail system whcih fully caters for intra-EU member VAT purchases.

Despite an ongoing discussion with Arvato's representatives, they have refused to allow me to provide VAT details ahead of purchase, in order to enable them to sell Avid products to me without adding VAT.

In their last email, they suggested I purchase from my local Avid reseller, in order that I can then reclaim VAT locally.

Long story short - if you live in the EU (outside Germany, which is I think where the Avid store is based) you will be unable to purchase without incurring VAT, will not be able to reclaim VAT locally, and will not be able to seek a refund from the Avids store. Basically, you'll be forced to pay around 20% extra for all your Avid purchases.

Way to go Avid - I won't be buying anything any time soon.

UPDATE: It looks like it IS possible to buy Avid ProTools HD upgrade plans from other resellers. In the UK, Jigsaw24, Mediaspec, KMR and others sell ProTools HD upgrades at the same price as the Avid Store.
