You need a mechanical license from the harry fox agency for use of the intellectual propriety, and you also need a master recording license from the record company, for use of the recording.

Most labels have somebody dedicated to clearing samples. Harry Fox is for compulsory clearing of the use of songs however it's wise to first go for a direct agreement with the publisher which will allow payment for copies sold as opposed to copies manufactured and may also let you out of paying a minimum. You could even end up having the publisher help promote your record. The Harry Fox deal is the worst possible by definition because they are required by law to give it to you.

Bob, as you seem well versed in the subject,
is it no longer common for artists to offer and get one-off payment licencing agreements?

I know this would happen frequently in the past.

These things may depend on whether or not the artist is own publisher or whatever...

Most samples can cost $5000 and up for songs on major labels. I think Barry White charges $7500. You can't expect to give up 20 to 50% of you publishing. I have seen people pay $100,000 for the sample clearance and 100% publishing.

There are companies that sole purpose is to get them samples cleared. They charge about a grand for that task.

One idea is to have some people replay the sample. That way you only have to play for publishing.
