Default volume pedal woes.

Hey all,
I'm using a Berhinger FB1010 with the eureka PROM. I like to use the volume pedal to clean up my tones sometimes rather than channel switching

I've got the minimum volume at 5 so all i have to do is drop down the pedal and it cleans up the tone a bit.
The problem I'm having is when i switch patches then go back to this one the volume is set at 5. I've saved it with the toe of the pedal down but for some reason it keeps loading at half volume.

anyone else have this problem?
any solution you can think of?
