It's most likely a restocked item. GC should know to check with Avid to see if the activation has been used or not, and if it has, to include a new one.
If you got it at a discount because it was a restock item, then I would take them at their word and just wait for it to arrive. Nothing you can really do until you get it.
But if you paid the same price as a new/unopened item, then I would cancel the order and ask them to send you a new one.
Either way, it is the dealer's responsibility to provide what they sold you.
